Terms of Use (EULA)

This End User License Agreement ("Agreement") is a legal contract between you and PenReps governing your use of the PenReps mobile application ("App"). By downloading or using the App, you agree to be bound by these terms.

1. License

PenReps grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions.

2. Subscriptions

PenReps Premium is offered as an auto-renewable subscription:

• Title: PenReps Premium
• Length: 1 month (auto-renewing)
• Price: $4.99 USD per month (or local equivalent shown in-app before purchase)
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription by going to your account settings in the App Store after purchase.
• No cancellation of the current subscription is allowed during the active subscription period.

3. Acceptable Use

You agree not to: (a) copy, modify, or create derivative works of the App; (b) reverse engineer or attempt to extract source code; (c) use the App for unlawful purposes; (d) submit content that is illegal, harmful, or infringes on others' rights.

4. AI Services

The App uses third-party AI services (Anthropic's Claude) to analyze writing. When you submit writing for scoring, your text is sent to Anthropic for processing. See our Privacy Policy for details. You are responsible for ensuring you have the right to submit any text you paste into the App.

5. User Content

You retain all rights to the writing samples you submit. PenReps does not store your writing samples after AI analysis is complete. You grant PenReps a temporary, limited license to process your writing for the sole purpose of returning AI scoring and feedback to you.

6. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind. PenReps does not guarantee the accuracy, reliability, or usefulness of AI-generated feedback. AI suggestions should be reviewed before use.

7. Limitation of Liability

To the maximum extent permitted by law, PenReps shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

8. Termination

This Agreement remains in effect until terminated. PenReps may terminate it at any time if you violate these terms. Upon termination, you must stop using the App.

9. Apple-Specific Terms

You acknowledge that this Agreement is between you and PenReps only, not with Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of this Agreement.

10. Changes to These Terms

We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the new terms.
